Art. 106 of the Swiss Federal Constitution distinguishes between two types of games of chance: games of chance in the strict sense, and lotteries and betting. Games of chance in the strict sense are regulated by the Federal Law on Games of Chance and Casinos (Casino Act) administered by the Swiss Federal Gaming Board, ESBK. The lottery and betting sector is regulated by the Swiss Federal Lottery and Commercial Betting Act (Lottery Act). Compliance with the Lottery Act is monitored by the cantons, in particular by the Intercantonal Lottery and Betting Board.
